A few years ago, the frozen dairy segment was populated by family-owned businesses, and a couple of big American companies that focused on certain regions.

In 00 the segment is becoming an arena for two huge international consumer products companies seeking to control a bigger chunk of theanded ice cream business. Nestle S.A. of Switzerland, the worlds largest food outfit with more than $46 billion in annual sales, and Unilever PLC, of London and Rotterdam, with over $6 billion in annual receipts, now own or are involved with several of the best knownand names in the ice cream aisle--Nestle, Haagen-Dazs, Dreyers/Edys, Good Humor, eyers, Ben & Jerrys, Godiva and Starbucks. With $750 million in annual sales, Marigold Foods is competing with its Kemps premium ice cream line for a share of this market.

What are they playing for? This years Ice Cream Industry trends show a continuation on the increasing demand for premium products (44% of the total sales)5 FORCES ANALYSIS OF THE PREMIUM ICE CREAM INDUSTRY

Alternatives Available To The Consumer Now, And In The Foreseeable Future (Threats Of Substitutes)

Premium ice cream undoubtedly has substitutes although not so much in comparison to the quality of the products. There are two main competitive arenas that exist

1. The first would be other ice creams not in the premium category and the now, very popular, frozen yogurt lines which target the same audience.

. The second, the expensive (or not) chocolate, cakes, croissants and other post meal consumable that are realistic options for the consumer. For instance, Ferrero Roche will assure you that their product is the perfect accompaniment to any meal.

Theseands need to be wary of how the customers make their choice for ice cream, as opposed to chocolate etc, and then premium ice cream, as opposed to the regular kind. The threat of substitutes in this industry is a negative force.

Industry Competitors (Intensity Of Rivalry)

Ben & Jerry exist in a consolidated market place with major players. The others are Haagen-Dazs and Kemps. There is severe competition between the players and as a result significant price competition including price wars have occurred. Price competition limits profitability by reducing the margins that can be earned on sales, which could push the industry profits down in the process. Ice Cream main ingredient is milk, which is a commodity and that, is why over the last year the price war has been vicious.

The intensity of rivalry in this industry is predicted to decline since these companies owned almost all the premium ice creamands and there is also and increases in the demand of this ice cream category. This force is a weak positive one right now but it will be strongly positive in the very near future.

New Entrants (Barriers To Entry In To The Premium Ice Cream Industry)

The possibility of new entrants in this market place is confined by two major problemsands and distribution.

Remembering that these are up-market consumers where by cheap alternatives is not necessarily sought for them, the key element is theand. This is an industry dominated by topands. It is a question of, I wouldnt be seen dead eating another ice cream¡ as opposed to, this is cheaper and tastes just like myand Ill buy this from now on!

The other barrier concerns distribution. With ice cream the idea of selling products through the Internet, despite the dried ice, which may accompany it, is not likely to be an option, consequently distribution to stores around the USA and globally will be expensive and require partners with extensive transportation network.

With both the above barriers the key entrants could be other ice cream manufacturers in regular ice cream market, because they already have the distribution network as well as the know how but all companies are leaders in this segment of the market as well. The launch of another premiumand by any of these companies will still take a large investment for these manufacturers to sell their image. A new entrant is a positive force in this industry.

Buyers (Bargaining Power Of Buyers)

The customers have no switching costs. Therefore all companies should be aware of upcoming price wars, to avoid losing customers to their rival.

Hence customers have high bargaining power. For example, during economic instability consumers are reluctant to spend their money on luxury products such as super premium ice creams.

Suppliers (Bargaining Power Of The Suppliers)

In this industry the suppliers could have great power of bargaining, even more the milk and cream suppliers. That is why the big players in this industry have conducted there business through vertical integration where they acquire other firms that supply them with the inputs needed such as raw materials or with the customers for outputs such as warehouses for finished products. They have also operated in backward integration by acquiring firms that are assets to the production process of the products to be sold.

Also by purchasing in great quantities, all companies have established a sense of loyalty, trust and commitment between them which it is extremely beneficial to the companies as far as mass production and the quality of the product.

The bargaining power of the suppliers in this industry was great when the industry was composed of many small companies but nowadays the bargaining power of the suppliers is a positive force.

STRATEGIES & RECOMMENDATION

Kemps

For nearly a century, Minnesota has known that Kempsand stands for quality dairy products and in the last 0 years it has blossomed. They started with a strong in-stateand presence and in the 80s, Marigold Foods took a more daring approach with constant product innovation, savvy marketing and joint ventures. They are now part of National Dairy Holding which amongst other things allowed Marigold to expand their distribution channels and grow from a regional player to a national one.

The Kempsand was created by a small family-owned creamery in Southern Minnesota. In 161, slightly ahead of the mergers and acquisitions that have reshaped the recently, Kemps Ice Cream Co. and two other dairies, one in St. Paul and one in Wisconsin merged to form Marigold Foods.

After six years of growth, Marigold merged with Ward Foods. Ten years later, Ward Foods sold Marigold to Wessanen . Over the next years the company grew substantially through acquisition and in 17 it entered a joint venture with Associated Milk Producers Inc., a partnership, which stands today.

As Marigold Foods grew larger under the charge of Wessanen, it also became more sophisticated. While much of the industry was looking for efficiencies of scale Marigold Foods was reinvesting in capital improvements and in marketing and R&D which resulted in distinctive packaging and point-of-sale marketing and innovative advertising campaigns like the latest Its the Cows outdoor advertising with an animated cow donning a variety of accessories to suit a particular product and flavor. What Marigold does today with product development, packaging and marketing, makes it look like a company with a 10-year head-start on the competition.

National Dairy is partnered with Dairy Farmers of America which is of great importance from an operations perspective because it provides Marigold with a partner for raw milk and access to dairy R&D. For a Midwest dairy, being involved in a partnership with a farmer cooperative is a real benefit, considering the shrinking regional milk supply.

Haagen Dazs

The origin of Häagen-Dazs dates back to the early 10s when Reuben Mattus insisted on only using only the finest, purest ingredients to produce ice cream that he would sell from a horse drawn wagon in the streets of New York. The family business grew and by 161 Mr. Mattus decided to form a new company dedicated to his ice cream vision. His strategy was differentiation through product leadership and he succeeded because theand quickly developed a loyal following. Its early success was created by word of

mouth and praise. In 176 his daughter opened the first Häagen-Dazs store and it was an immediate success. Haagen Dazs attained a real competitive advantage by offering one of the best premium ice creams in the market and through out the years the kept the same business model. Seven years later The Pillsbury Company bought Haagen-Dazs but they remained committed to the tradition of superior quality and innovation on which this ice cream was created. Through out the different merges and acquisitions Haagen Dazs has maintain its competitive advantage and this is why it over 80 years after its creation thisand is recognize as a premium ice cream with top quality ingredients and wide range of innovative flavors.

Ben and Jerrys

If Uniliver wants to remain a key player in the premium ice cream industry with the Ben and Jerrysand, they have to carefully analyze the mistakes made by Ben & Jerrys over the last five years.

ɨ At one stage, Ben & Jerrys pricing strategy worked really well but the demand over recent years shifted towards lower priced products, leaving pricing strategies being a big issue for the company. All of Ben & Jerrys promotions were gained through the companys socially conscious practices but price wars with main competitors left the company having to pull funds off advertising campaigns to fund price discounts.

ɨ Due to the fact that imitations for the product were being developed more rapidly, Ben & Jerry changed their primary marketing goal to establish products that cannot be imitated, but the technological developments of the company did not allowed them to launch the products within a decent time limit. It will be for Unilever key to introduce new flavors quickly. Research will be key in identifying the market in any region or country B&J wishes to operate, especially into consumers needs and wants.

ɨ Ben & Jerry was proud of the success rate of their relaxed, casual culture and having employees involved in the decision making. However this policy needs to be reviewed as decisions are taking too long to be made due to large staffing numbers.

ɨ Ben and Jerrys also faced some economic and social factors that affected them. In 14, sales were flat, profits were down. The coming of the baby boom in the 10s meant a middle class society that was more health conscious. Ben & Jerrys realizing its fall in sales, quickly responded to the changes in consumer demands and introduced Ben & Jerry Lite. This line failed because they didnt forecast and acknowledge the changes in consumer tastes, and was faced with increasing competition with Haagen-Dazs.

ɨ Their social commitments to their customers community and suppliers have contributed to a successful and unique image. Ben & Jerry donated a portion of their sales from their "Rainforest Ice Cream" back into environmental preservation causes in South America. Such efforts had contributed to winning over certain consumers, however we dont know to what extent this will have on winning the hearts of international consumers.

There are a few things that Ben and Jerrys could possibly do to improve their success in the near future. In todays environment, change, rather than stability, is necessary. One of the reasons why B&J lost market share is because they failed to change themselves and adapt to a new competitive environment. To overcome this, Ben & Jerry need to identify the main barrier to change such as consumer tastes. This can be overcome through the development of a marketing plan, as there seems to be no real evidence that Ben & Jerry have done this.

Employee productivity is one of the key components of a companys efficiency and cost structure, so this needs to be improved upon in order to make the company more competitive, although I suspect since Uniliver bought them this not as big of an issue any more.

In conclusion, I think that Ben & Jerry has the potential to prosper as long as they are prepared for upcoming changes in consumer needs and wants, compromise between maintaining their company image and satisfying their investors needs, and try to reduce their costs by considering all of their other options.

regret. The man in this story seems to have made many mistakes in his life. As he tells us

right from the beginning, his first mistake is marrying his wife, Marge, and his second

mistake was getting her pregnant. Marge seemed to want to have control over their lives,

Essay service for your "my side of the matter" paper because she moves them to her Aunts house where her husband is not welcome. There,

being as submissive as ever, doesnt argue with her aunts when told her husband cant

sleep with her. To me, her aunts are a little naive to think that this married couple should

not sleep in the same bed. But on top of that, the aunts treat this man with no respect,

insulting his manhood and being outright disrespectful towards him.

I also think this man needs to communicate more with his wife. They seem to be

on a strange level, one that is not very loving or sensitive. Marge hardly ever sticks up for

her husband while her aunts bash his confidence, making fun of him for just cashiering at a

store. Personally, comparing this story to "The Somebody" I think they should be grateful

this man even has a job. There is nothing they can do about their niece being pregnant, and

its not like she isnt married. Marge needs to move on and connect with her husband, I

think they could work out most of their problems if they just talked with each other.

The main tone is this story would probably be described as annoyed. Everyone

seems annoyed at each other. In the beginning the man is annoyed with his life and his

choices. The married couple are annoyed with each other and finally, the aunts are

annoyed with the nephew-in-law and each other. No one in this story seems to be happy

about anything, they all fight, they are all angry, and they cant really agree on anything,

leaving them with the extreme measures the aunts took. Whether the husband is telling the

truth or not, I do not know. But by the looks of that family, it wouldnt surprise me if itwas.

One part of this story that is a strong image and opened a doorway for discussion

happened many times. Each thing the husband said something about the aunts, I get the

feeling he is only doing it because deep down he probably likes them. He talks about them

numerous times, and to me, if he didnt like them so much, he would never talk about

them as much as he does. Instead, to some extent, I think he likes the way they are strict.

In the beginning, he said himself that he regretted marrying his wife. So when the aunts

told them they couldnt sleep together, I think the husband was happy about it, although

he didnt want to show it.

It seems like there is something missing in this story. I dont find it really is making

a very good point. I am confused as to why the man felt he had made so many mistakes.

Why doesnt he get out of it if he is so unhappy? I think there is a deeper meaning than

what I am getting from it. "My side of the matter"

Order your Smoking paper at affordable prices! The City of Winnipeg Smoking By-Law The by-law that was passed by city council in July is subject to a number of interpretations and is also subject to a variety of enforcement standards. This is a totally unfair bylaw which makes one set of rules for bars and another for restaurants with liquor licenses and yet another for unlicensed restaurants. Lets look at a number of scenarios to try to clear the muddy waters. I have an unlicensed restaurant… what can I do? OPTION 1 You can go 100 % non smoking, which is the intent of the bylaw or OPTION You can ban anyone under the age of 18 from coming in and have 100% smok- ing or you can declare any other ratio that you decide. Ie. 50 50 Problem Legal opinion says that this may be challengeable under Human Rights, but we are banning under 18 from lounges and casinos already. It is not legal to buy ciga rettes, drink or gamble under 18 and the city is saying that they shouldnt be in any area that has smoke. OPTION You can apply for a dining room and cocktail lounge license. You would make applica- tion to the Manitoba Liquor Commission to get a license for your premises. The desig- nated cocktail lounge would ban under 18 and would have smoking allowed. You would have the option of selling liquor or not. If you take this route and want to serve custom ers before 00 A.M., which is the earliest that lounges are able to open, you would need to apply for written permission from the MLCC. I am told that it should not be a problem to get this permission. Problem It is costly and time consuming to get a license and part of your establishment might have to be reconfigured to identify the cocktail lounge area. OPTION 4 Some establishments that have two clearly separated areas are going to have one area as a restricted area and have smoking in that section. Whether this is legal or not is a gray area, but when you consider the level playing field scenario you would think that it shouldnt be necessary to get a liquor license to compete on a level playing field with licensed restaurants. OPTION 5 Another "gray area" option is timed restrictions. Example You have non smoking be- tween the hours of 500 P.M. and 00 P.M. and after 00 P.M. no one under 18 is allowed to come in and smoking is allowed. I have a licensed restaurant…..what can I do? You are allowed to have smoking in your lounge as long as you do not allow anyone under 18 in that area. Some other possible problems may arise if people have to go through your smoking area to get to your washrooms or to the non smoking area. Lounges do not have to be walled off, but an effort should be made to minimize drifting of smoke. Within this area you can designate it as 100% smoking or any other ratio that you decide. If you have a lounge that borders closely on a dining room you might take reasonable steps to control drifting of smoke by declaring the area in the lounge which borders on the dining room as a non smoking area. What are the restaurants obligations under this bylaw? Your only obligations under this bylaw are to designate the areas as you are defining them and to post non smoking signs in the applicable areas. A customer smoking in a non smoking area is subject to a fine not the restaurant. The problem with this scenario is that if you do nothing about the smoker you will anger the non smoking customers around them. Your role is not one of an enforcer under the bylaw, but you are forced into this role by good business rules. Other info These rules apply only to the public areas of the restaurant. You can still have a smoking staff room. Banquet rooms….If you have a party booking a private room for a banquet which is a social event that room can have smoking and children present, but if it is for business purposes (which ironically would have adults only % of the time) must be smoke free. Hint You might consider booking business meetings followed by social events separately if the customer wants a smoking event. Enforcement This by-law comes into effect January 1, 00 and enforcement of this bylaw is being headed up byian Rivet (86-67) of the City of Winnipeg Environmental Health Department. This bylaw applies to all of the city, but the enforcement will be concentrated in the Greater Winnipeg area looked after by the city health department. The province has stated that it will not be adding any staff to enforce the bylaw in the other areas. Enforcement in these areas will probably be only by customer complaint. Challenging the by-law There is a possible challenge to this by-law based on the fact that the City may not have the power to pass a bylaw which has exclusions. This means that any bylaw passed would have to cover all public places, which would create a far more level playing field. This would require a court challenge which would be costly and we would have to call on our members for support in this matter. Please keep in touch with me on this issue and how it is affecting you. If you have any concerns regarding the enforcement please call. Have a great Christmas and Happy New Year. Negative Feedback The process by which a change is minimized. (COMPENSATION).

• Cold temp. causes increased heat production. Thus body temperature is elevated.

• Dehydration causes increased thirst. Decreased urine volume. This causes the body to accumulate fluid. • Hypocalcemia causes Ca++ mobilization from bones. The increased plasma calcium corrects the hypocalcemia.

• Fall in blood pressure causes increased heart rate, force, increased blood volume. These all elevate blood pressure.

Positive Feedback (amplification) mechanisms.

o Blood clotting. Platelets release chemicals which attract more platelets and trigger them to release their chemicals.

o Birth process As infant moves along the birth canal, stretching tissues and stimulating stretch receptors, this causes release of oxytocin, which cause muscular contractions and moves the infant along birth canal, stimulating more receptors.

o Control of secretion of digestive juices.
