Shared by many Americans, Keith Stroup founded the National Organization for the Reform of Marijuana laws or NORML in 170. NORML views the laws against the possession and sale of marijuana as unfair and works to reform them. In the thirty-two year history of the organization, Keith, along with the other reformers, has made little headway on in this war on drugs. The reformers of NORML work diligently day in and day out to get justice for responsible pot smokers in a society where marijuana smoking appears taboo for many citizens. According to NORML, half a million US citizens get arrested each year on marijuana offenses.

NORMLs main purpose, "lobby in Congress and state legislatures for more rational and cost-effective marijuana policies," has other sub-purposes as well. (NORML home) NORML also provides legal assistance, in the form of expert witnesses and criminal attorneys specializing in the defense of marijuana crimes. (NORML Home) Along with attorneys, NORML also provides testimony to help offenders defend themselves in a court of law. This not-for-profit organization also serves as a marijuana law reform advocate with the media nationwide. The mission statement of NORML, adopted by the board of directors Feuary 7, 1, to move public opinion sufficiently to achieve the repeal of marijuana prohibition so that the responsible use of cannabis by adults is no longer subject to penalty, says what the organization strives to achieve. (NORML home)

Across the nation, NORML works for the decriminalization of marijuana for recreational and medical use. NORML believes, "All penalties should be eliminated for responsible use." (NORML home) Not only does NORML believe in marijuana decriminalization, but the organization also believes that by doing this, "the crime, corruption, and violence caused by the black market would see a significant reduction due to a legally regulated market […] where consumers could buy marijuana in a safe and secure environment." (NORML home) NORML also works toward the "legalization of hemp, non-psychoactive marijuana, for industrial use." (NORML home)

In terms of national effort, NORML has recently released a half million-dollar ad campaign aimed at getting the word to the masses that you can still achieve success if you smoke marijuana. This campaign features politicians, such a Mayor Bloomberg of New York City, who admits to smoking marijuana. (Wishnia) NORML also maintains an internationally viewable website with which they keep the viewers aware of news around the United States and aoad about the goings on in the marijuana community.

Texas has some very strict laws on the possession and sale of marijuana. The penalties in Texas range from misdemeanor possession of two ounces or less, which can carry one hundred-eighty days in jail and a two thousand dollar fine, to felony possession of over a ton, which carries five to ninety-nine years in prison and a fifty thousand dollar fine along with a permanent record that will haunt the offender if they ever get released from prison. (NORML home) The laws become even stricter if money is involved in the trade. Even a gift of a quarter of an ounce carries one hundred eighty days in jail and a two thousand-dollar fine. (NORML home) Sale to a minor, under the age of eighteen, carries an immediate felony conviction with two to twenty years in prison and a ten thousand-dollar fine. (NORML home) If the sale takes place within one thousand feet of a school or three hundred feet of a special area, such as a public pool, youth center, or a video arcade, the penalty goes to the next level of punishment. (NORML home) Drug paraphernalia possession in Texas carries only a civil citation and up to a five hundred dollar fine, while the sale of it holds a misdemeanor conviction, one year in jail, and a three thousand-dollar fine. (NORML home)

Among the efforts in Texas, new chapters need to be founded, money raised, and membership increased. (NORML home) Texas NORML has a new president to help achieve these goals. He is Mark Stepnoski, a former Dallas Cowboy center. Mark believes in the responsible use of marijuana as well as the rest of the organization. He also stated that the continued incarceration of responsible marijuana smokers is a waste of taxpayer money and believes marijuana should fall into the same category as alcohol for responsible use by adults only. (Fox)

The National Organization for the Reform of Marijuana laws aims for the legalization, or having a regulated market, and decriminalization of marijuana. NORML will continue its national efforts with ad campaigns and state chapter efforts to reform the laws in each state. NORMLs philosophy emanates in a statement made by President Jimmy Carter, August , 177. "Penalties against drug use should not be more damaging to an individual than use of the drug itself. Nowhere is this more clear than in the laws against the possession of marijuana in private for personal use." (NORML home)

Order your CONSUMER BEHAVIOR "SHOPPING THROUGH THE TWILIGHT ZONES OF STORES" paper at affordable prices! The Twilight Zone

Issue

The primary issue my case deals with is the initial zoning upon entering a store. When you are walking into a store you usually dont notice the first couple of things you see. This is because we have trained ourselves to walk at a faster pace in order to get from the parking lot to the actual store, so that when you enter the store, those first couple of steps are geared towards slowing down. Not shopping around. Whatever is in that particular zone is pretty much lost to the consumers. Usually when entering a store consumers are faced with one of the following, a display, a sign, or even a sales clerk-asking if they can help you. Chances are the consumer will be moving too fast to absorb the key things that marketers work so hard at to try and catch their attention with. Another issue is placing shopping baskets at the front of the store. Since the baskets are only offered at the front of the store consumers often miss them, which means they only buy what they can hold in their arms. The third issue in my article is the architectural design of the store. How the store is designed reflects upon your sales. For instance, if a customer feels uncomfortable with their surroundings, they are less likely to purchase goods from that particular store.

Rule The first rule addressed is zoning, which many stores came up with to grab attention of those entering the store, by putting sale items such as huge bins of marked down items in the front. Another idea was to put a horizontal table so that the consumer must slow down in order not to run into the table. This also attracts attention to the items on the table. It was also suggested that the small impulse buys be placed in this area of the store so that they are more noticable on the way out. In regards to the shopping baskets, it was suggested that retailers place shopping baskets throughout the store so that when needed, the consumer can just take one, rather then having to backtrack and go to the front of the store again. This will increase the amount of things that people buy because it will save time, as well as the amount of things in their arms. The third rule addressed in the case in the section entitled, Shoppers Move like People, is that shoppers automatically move to the right of the store upon entering it. This is a learned trait stemming from which side of the road we drive on. So anything placed on the right side of the store should be your most important goods. Also the feel the store gives off to a consumer reflects their purchasing behavior. Many things are displayed to be seen at a head on view but, because we usually walk at an angle this typically does not work. So all the money put into the display is a waste because it does not catch peoples eye unless they look at it straight on.

Analysis

These articles were very interesting. The Twilight Zone approached the issues that many stores face on a day-to-day basis with the way consumers shop. People are so worried about rushing to do everything that they forget to slow down and take a look at the things around them. This obviously seems to be the case with how people enter a store. They are worried about rushing in the store so fast that by the time they realize they are in the store, they have missed products along the way. This is why retailers should place a huge priority on the layout of the store. Many stores have decided to make the shopping experience as easy as possible and have seen a huge increase in their sales. They have done this simply by just being there to help the customers whether its handing them a basket or holding on to their personal items at a coat check area. Whatever it is, it has made the shopping experience more enjoyable for consumers everywhere. Consumers now feel as though they do not have to juggle the many objects theying with them while they shop. This has left more hands for shopping and less for dealing with unnecessary items. Because we are naturally trained to go toward the right, if a store wishes to get the consumer to buy something, it should be placed just slightly to the right of where they are standing. Retailers are starting to notice that if they tilt a display sideways just a little bit, more people will take time to look at it, rather then if it was straight on. It is easier because our eyes are trained to look in the direction that we are walking, and if the items on the shelf are on either side it makes it harder to look where we are going. Because of this many stores have chevroning shelves, which are angled and not parallel. They allow people to see more of what the store has to offer.

Conclusion

Underhill has some great ideas in regards to store zoning. My favorite one is to use the front of the store as a source to grab attention to the back of the store. This way nothing goes unseen by the consumer. In the case, You Need Hands, store zoning was such a problem that customers were even missing the shopping baskets. This is why it would be effective to place shopping baskets throughout the store so that people can pick them up as they go. Plus when people go in a store with the intent to buy one item, they feel they dont need a basket. If you place them throughout the store it will make it easier to decide if they want to purchase more items. For me there are some stores that make me feel very uncomfortable on entering. Simply because of the layout and the annoying salespeople who stop you every three feet to ask if you need help. These are the stores that I often do not purchase much in. Comfort plays a big role in shopping. If the consumer does not feel comfortable chances are they will not purchase much. Retailers should make it a point to help the consumer feel comfortable, a simple "Hello" might be better then "Can I help you?" No one likes to admit that they cannot do something on their own, the second they walk in a store. As a shopper I feel that the shopping experience should be an easy one. This all reflects how it is set up. People do not like to work hard to find items to purchase. As for myself, I am more likely to buy something that is displayed in a way that I dont have to dig in order to find what I want. The decision to purchase something is hard enough; we dont need the shopping to be hard as well.

Biblical Reference

Ecclesiastes 11

He has made everything beautiful in its time. He has also set eternity in the hearts of men; yet they cannot fathom what God has done from beginning to end.

To me this verse means that we can never be completely satisfied with earthly pleasures and pursuits. Nothing but the eternal God can truly satisfy us. He has built in us a restless desire for the kind of perfect world that only can be found in his perfect rule. In this aspect, no matter what you do to change the patterns of the world to fit mankinds liking, there will always be someone who will not be satisfied. This too applies with these cases, no matter how you change the layout of your store, where things are found, zones, how things are displayed. You are not going to reach everyone because someone will always be left unsatisfied. So instead seek to satisfy the heavenly Father rather than people of this world.

Order your Free Speech & The Constitution paper at affordable prices! Offensive Speech What limitations, if any, should be placed on it?

"Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof; or aidging the freedom of speech, or of the press, or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances" (The Constitution). The first amendment of the Constitution states that people have the freedom of speech. Plain and simple this means that people have the right to say whatever they want, whenever they want, however they want. The Bill of Rights does not address offensive speech, so, there is no way of knowing what offensive speech actually is. Offensive speech to one person could be the daily prayers of another. The freedom of speech was given to the people to protect all speech, even speech that is extreme, outrageous, and offensive.

So what limits should be placed on offensive speech? According to the first amendment there should not be any. The Bill of Rights gives Americans the right to the freedom of speech, therefore the American government cannot take that right away by labeling certain speech offensive. In the case of Cohen vs. California, Justice Harlan says people have the right to free speech and "So long as the means are peaceful, the communication need not meet the standards of acceptability" (Charbonneau). As long as the speech of one person does not directly affect another persons physical well being, then there should be no limitations placed on that speech. According to the Encyclopedia of Censorship, "The court said that some categories of speech are simply no essential part of any exposition of ideas, and are such slight social value as a step to truth that any benefit that may be derived from there is clearly outweighed by the social interest in order in morality" (Green). How can the court decide what speech is deemed offensive? There are no facts to prove that nothing positive or valuable can come out of certain speech. It is impossible to set a standard of what is considered offensive without placing a bias of some kind. Because there is no universal definition of offensive speech, a set law regarding offensive speech is unattainable.

Some might say that "offensive" speech holds no value, but something that holds no value to one person might hold much value to the next. "Either you emace a free society and tolerate the objectionable song lyrics, bomb recipes, racially offensive remarks and nude photos, or you enact laws against offensive materials and invite the routine arrest of writers, artists, photographers, philosophers, musicians, scientists and professors" (Crowley). If the song lyrics of a musician offend ONE person then is that song offensive and not protected by the Constitution? Or if a scientist describes how to make a certain chemical reaction that could also be used as a bomb is that considered offensive or dangerous? The real question is does anything offensive, obscene, or inappropriate ever hold any value? The answer is yes, they do. Some people in the colonies found the idea of a revolution very offensive, but there is hardly an American today that would argue whether or not the idea of a revolution was a valuable idea. Anything different or uncommon might be offensive because it threatens peoples routines or what they are used to. The fact is that no reform of government and no revolution ever happened because of a popular idea that everyone agreed with. The idea that the earth was round was not formed out of a public opinion. It took one man to speak out what he thought which seemed crazy at the time but ended up being correct. So how then can the American government, the government of the freest country in the world, ban some forms of speech because it is offensive to another person? Nothing will ever make EVERYONE happy. People must learn that to have the right to free speech they have to be prepared for someones words that one day might offend them. No regulations can be placed on speech and also allow one to have the freedom of speech at the same time. Equality is one of the most important virtues in America. There is no difference between segregating people by their color than by their words. If the black skin of an African American offends a white person, that white person has no right to label the African American as offensive. The same is with speech Just because the speech of one person is different, it is unfair, and certainly not equal, to discriminate against the words of one person and not the words of the next because the content of their speech. There should be no limitations placed on any kind of speech as long as it does not cause direct physical damage to someone or their property or interfere with any other freedom guaranteed by the constitution.. Otherwise words are only words and there should be no law stating that certain things cannot be said. The first amendment was made to protect all forms of speech, especially offensive speech. The founding fathers knew that some speech would offend people; therefore they gave people the freedom of speech so that they could say those things without being punished. If the Bill of Rights gives Americans the right to speak, then Americans should say whatever they want to say without the fear of punishment or consequences. Every so often something great comes from something out of the ordinary. "We cannot indulge the facile assumption that one can forbid particular words without also running a substantial risk of suppressing ideas in the process" (Charbonneau). Without free speech there is no such thing as free ideas. Or at least there is no point in being able to think anything if it cannot be said in some way. By limiting ones thought process and communication by offensive speech laws, advancements, discoveries and other such positive events may never occur. In some way or another all speech is offensive speech depending on who one asks. People are all different and no speech can ever satisfy every single one of them. There is no way to make laws on any offensive speech if all speech is not made illegal. Some speech is offensive. All speech is free.

Bigotry alienates and victimizes people. In "Black Boy" Richard Wright introduces a character who is both a victim and a victimizer.

Richard Wrights dysfunctional family victimizing tendencies become clear when his father abandons him and becomes confused, unstable, and untamed. Later, in court during child support hearings, Wright resents his smiling father and feels for his crying mother. In another instance Wrights mother asks him to go ask his father for money and finds him "comfortable" with another woman. His father laughs again, and denies having any money but gives them a nickel after "the woman" says how cute he was. Hurt by his fathers laugh, he takes the nickel and leaves. At home, his family yells at him constantly. All the yelling makes him turn fear into anger and hate becoming a victimizer and giver of pain. For example he threatens his uncle with a razor blade, kills a cat laughing sarcastically at his fathers request and physically fights his aunt in self defense.

Despite all, Wright becomes a hard working and responsible family man. This time, racism is the enemy. Affected by societys prejudices because he is black; he feels betrayed, used and following threats, he quits his job and moves to another more abusive job loader with physical and verbal abuse. Emotionally affected, Wright believes hate is part of the victim or victimizers existence. In adulthood, racism becomes a slap in the face leading to violence out of fear and anger. The victim turns into a victimizer and a new cycle of violence begins. In racist time, life becomes hard but hope does not die.

Essay writing services for Black Boy papers

"Black Boy" is a straight forward, strong and honest novel full of emotions that question the reasons for violence in the world. The author clarifies that violence creates confusion causing the victim and victimizer to get lost in the cycle of violence. The reader can see from the title alone that racism is alive and well and he calls on society to stop the pain. But, he also justifies pain and violence in self defense when he describes the beating of the woman and her blood on the floor.

Richard Wrights writing style and his own life on the background is eye catching and profound. His life time line allows the story to flow from one period to another capturing the legacy of racism and slowly waving it into societys faic.

Marijuana is a relatively harmless drug that governments around the world have made illegal. If legalized, marijuana can be beneficial to society in a number of ways whether it be for medical, economic, or public safety reasons. Marijuana has been proven to treat several life debilitating, and even life threatening diseases. Although it is not a cure, marijuana can ease the pain and suffering of a dying person. Another benefit of legalization is the financial gains that governments will accomplish through the taxation of marijuana. This is a realistic claim if marijuana sales are compared to that of cigarettes; governments make billions each year from cigarette taxes (Caputo and Ostrom 484). Every year law enforcement spends countless man-hours trying to apprehend marijuana dealers and growers. This time would be better utilized in dealing with more serious crimes. This essay will display some main reasons why marijuana is a substance with beneficial uses and applications. First, marijuana can be used as a treatment for the effects of diseases such as AIDS, cancer, glaucoma, and other terminal diseases. A study carried out in California clearly demonstrates the effectiveness of marijuana as a treatment for cancer "Over 74 percent of the cancer patients treated in the program have reported that marijuana is more effective in relieving their nausea and vomiting than any other drug they have tried."(Zeese 10). Chemotherapy for cancer patients often produces nausea and vomiting. Marijuana has been proven to relieve these symptoms and there have been no known side effects recorded (Ad Hoc Group of Experts part 4). The people who would benefit the most from the legalization of marijuana are the terminally ill. These people are not criminals at heart, because they only require marijuana as a way toing relief from their ailments. Moreover, a government should feel obligated to provide terminally ill patients with marijuana to relieve pain. Governments such as Canada and the United States are supposed help its people, and by legalizing marijuana, many terminally ill citizens will feel less pain and suffering. If marijuana were to become legalized, governments could make a large amount of revenue through taxes. In the United States, billions of dollars each year in revenue are produced through tobacco taxes (Caputo and Ostrom 484). If marijuana became a manufactured product, the government could set taxes on the sale of that product. Once legalized and regulated by the government, the money raised through taxes could be used to improve the country. Moreover, several other things can be produced commercially using the marijuana plant. There is a possible revenue obtainable from hemp, which can be manufactured into clothing material, vegetable oil, paper product, and livestock feed (Caputo and Ostrom 485). If legalized, marijuana has the potential to generate a lot of revenue for a government, and this gained revenue can only help the country. Crime is a problem just about anywhere in Canada and the United States. However, crime enforcement energy is often spent dealing with cases that are not necessary. The police spend useless time trying to arrest marijuana growing and smokers. If marijuana is legalized, drug-fighting resources could be better used against the drug trade of cocaine, heroin, and other dangerous substances. Furthermore, if the government regulated the sale of marijuana, a majority of drug dealers would go out of business. This would decrease the amount of black market drug money, and increase the revenue for the government. Also, legalization of marijuana could also take some pressure off of the court system. The court system would have less cases to deal with, and more important cases could be processed faster. The legalization of marijuana would make Canada and the United States a safer place to live, because law enforcement would be directed fully at the true criminals in society. Marijuana is a substance with many useful applications in Canada and the United States. It has been proven to be a great treatment for the pain and discomfort of terminally ill patients. Legalization would make marijuana easily accessible to these people. Also, if the government would legalize and regulate the sale of marijuana, large tax revenues could be available to the government. This increased revenue could help the country become a better place to live, whether it be through improved highways or new schools. Legalizing marijuana would take pressure off of the legal system. Law enforcement could concentrate on severe criminal problems, rather than getting overloaded with marijuana cases. All of these benefits are from a simple plant called marijuana, and yet the government will not allow their country to enjoy all of the good things that could come out of the legalization of this crop.

STUPID PANTS (or Poopie Pants) I call them, cause you¹d almost expect the wearer to be going Duhhh, with his index finger hung over his lower teeth; but I suppose theyre better than the genesis of this style, which was regular pants pulled halfway down to all but expose the buttocks - purposely - apparently to get some kind of reaction, exactly from whom one wonders.

The teenager I saw was getting on the bus, paying his fare, and what caught my attention was his struggle with the books and the pants. The bus was a Driver Has No Change affair of course, so you either had to have the right change or inject bills into the farebox and watch them slip away through a window, belts whisking them away to the lower depths. I didn¹t have the right change, so it was bills for me, but the kid did, and thats when the notable activity with the pants came.

Now Im not one for high tight crotches either, being of the school that pants are one of mans greatest inventions (finally being adopted by women, and not a moment too soon), covering the lower part of the body yet offering the convenience of a fly front with a zipper, belt loops, and pockets, usually four in number, conveniently placed to permit access to whats inside, be it handkerchief, wallet, personal items, bills or change. Change was the item in question today, being that it was the front end of a bus.

The kid, books balanced in one arm, reached down, lifted up the bottom of his jacket with the other hand, went naturally into the hip area where pockets traditionally are - and missed. No pocket there, where weve become used to them over the years. You see, the new crotch-fallen pants also come with side-fallen pockets, so to reach your change at the bottom youve got to have knuckle-dragging neanderthal arms. But this normal-armed kid was up to the task, as people waited in the rain behind him. Down he went, fumbling his books, straight to the bottom of his thigh-high pocket, and came up with a handful of change. He proceeded to allow the change to drip from the bottom of his fist into the change slot until he had satisfied the maw of the farebox, and then went to put the rest back into his pocket. Professional writers help on poop essays Once again he went for the nonexistent upper pocket (old habits die hard), and in the process dropped several coins onto the floor before he realized again that the pocket he sought wasnt there anymore. However, being a persistent sort, he once again located the thigh pocket and dropped the rest of the change back to its knee-high repository, then swivel-duck walked (how else can you walk when the crotch of your pants has dropped a full 1 inches from the hinges for your legs?) back to his seat where he sat with his big high-style sneakered feet in the aisle. Figures.

Now I assumed he was fairly intelligent, but his Stupid Pants unfortunately made him LOOK stupid, and holding up the rest of the passengers didnt help. They simply sighed, rolled their eyes and cursed silently while he fumbled. Right in style, yeah.

A few years ago, the frozen dairy segment was populated by family-owned businesses, and a couple of big American companies that focused on certain regions.

In 00 the segment is becoming an arena for two huge international consumer products companies seeking to control a bigger chunk of theanded ice cream business. Nestle S.A. of Switzerland, the worlds largest food outfit with more than $46 billion in annual sales, and Unilever PLC, of London and Rotterdam, with over $6 billion in annual receipts, now own or are involved with several of the best knownand names in the ice cream aisle--Nestle, Haagen-Dazs, Dreyers/Edys, Good Humor, eyers, Ben & Jerrys, Godiva and Starbucks. With $750 million in annual sales, Marigold Foods is competing with its Kemps premium ice cream line for a share of this market.

What are they playing for? This years Ice Cream Industry trends show a continuation on the increasing demand for premium products (44% of the total sales)5 FORCES ANALYSIS OF THE PREMIUM ICE CREAM INDUSTRY

Alternatives Available To The Consumer Now, And In The Foreseeable Future (Threats Of Substitutes)

Premium ice cream undoubtedly has substitutes although not so much in comparison to the quality of the products. There are two main competitive arenas that exist

1. The first would be other ice creams not in the premium category and the now, very popular, frozen yogurt lines which target the same audience.

. The second, the expensive (or not) chocolate, cakes, croissants and other post meal consumable that are realistic options for the consumer. For instance, Ferrero Roche will assure you that their product is the perfect accompaniment to any meal.

Theseands need to be wary of how the customers make their choice for ice cream, as opposed to chocolate etc, and then premium ice cream, as opposed to the regular kind. The threat of substitutes in this industry is a negative force.

Industry Competitors (Intensity Of Rivalry)

Ben & Jerry exist in a consolidated market place with major players. The others are Haagen-Dazs and Kemps. There is severe competition between the players and as a result significant price competition including price wars have occurred. Price competition limits profitability by reducing the margins that can be earned on sales, which could push the industry profits down in the process. Ice Cream main ingredient is milk, which is a commodity and that, is why over the last year the price war has been vicious.

The intensity of rivalry in this industry is predicted to decline since these companies owned almost all the premium ice creamands and there is also and increases in the demand of this ice cream category. This force is a weak positive one right now but it will be strongly positive in the very near future.

New Entrants (Barriers To Entry In To The Premium Ice Cream Industry)

The possibility of new entrants in this market place is confined by two major problemsands and distribution.

Remembering that these are up-market consumers where by cheap alternatives is not necessarily sought for them, the key element is theand. This is an industry dominated by topands. It is a question of, I wouldnt be seen dead eating another ice cream¡ as opposed to, this is cheaper and tastes just like myand Ill buy this from now on!

The other barrier concerns distribution. With ice cream the idea of selling products through the Internet, despite the dried ice, which may accompany it, is not likely to be an option, consequently distribution to stores around the USA and globally will be expensive and require partners with extensive transportation network.

With both the above barriers the key entrants could be other ice cream manufacturers in regular ice cream market, because they already have the distribution network as well as the know how but all companies are leaders in this segment of the market as well. The launch of another premiumand by any of these companies will still take a large investment for these manufacturers to sell their image. A new entrant is a positive force in this industry.

Buyers (Bargaining Power Of Buyers)

The customers have no switching costs. Therefore all companies should be aware of upcoming price wars, to avoid losing customers to their rival.

Hence customers have high bargaining power. For example, during economic instability consumers are reluctant to spend their money on luxury products such as super premium ice creams.

Suppliers (Bargaining Power Of The Suppliers)

In this industry the suppliers could have great power of bargaining, even more the milk and cream suppliers. That is why the big players in this industry have conducted there business through vertical integration where they acquire other firms that supply them with the inputs needed such as raw materials or with the customers for outputs such as warehouses for finished products. They have also operated in backward integration by acquiring firms that are assets to the production process of the products to be sold.

Also by purchasing in great quantities, all companies have established a sense of loyalty, trust and commitment between them which it is extremely beneficial to the companies as far as mass production and the quality of the product.

The bargaining power of the suppliers in this industry was great when the industry was composed of many small companies but nowadays the bargaining power of the suppliers is a positive force.

STRATEGIES & RECOMMENDATION

Kemps

For nearly a century, Minnesota has known that Kempsand stands for quality dairy products and in the last 0 years it has blossomed. They started with a strong in-stateand presence and in the 80s, Marigold Foods took a more daring approach with constant product innovation, savvy marketing and joint ventures. They are now part of National Dairy Holding which amongst other things allowed Marigold to expand their distribution channels and grow from a regional player to a national one.

The Kempsand was created by a small family-owned creamery in Southern Minnesota. In 161, slightly ahead of the mergers and acquisitions that have reshaped the recently, Kemps Ice Cream Co. and two other dairies, one in St. Paul and one in Wisconsin merged to form Marigold Foods.

After six years of growth, Marigold merged with Ward Foods. Ten years later, Ward Foods sold Marigold to Wessanen . Over the next years the company grew substantially through acquisition and in 17 it entered a joint venture with Associated Milk Producers Inc., a partnership, which stands today.

As Marigold Foods grew larger under the charge of Wessanen, it also became more sophisticated. While much of the industry was looking for efficiencies of scale Marigold Foods was reinvesting in capital improvements and in marketing and R&D which resulted in distinctive packaging and point-of-sale marketing and innovative advertising campaigns like the latest Its the Cows outdoor advertising with an animated cow donning a variety of accessories to suit a particular product and flavor. What Marigold does today with product development, packaging and marketing, makes it look like a company with a 10-year head-start on the competition.

National Dairy is partnered with Dairy Farmers of America which is of great importance from an operations perspective because it provides Marigold with a partner for raw milk and access to dairy R&D. For a Midwest dairy, being involved in a partnership with a farmer cooperative is a real benefit, considering the shrinking regional milk supply.

Haagen Dazs

The origin of Häagen-Dazs dates back to the early 10s when Reuben Mattus insisted on only using only the finest, purest ingredients to produce ice cream that he would sell from a horse drawn wagon in the streets of New York. The family business grew and by 161 Mr. Mattus decided to form a new company dedicated to his ice cream vision. His strategy was differentiation through product leadership and he succeeded because theand quickly developed a loyal following. Its early success was created by word of

mouth and praise. In 176 his daughter opened the first Häagen-Dazs store and it was an immediate success. Haagen Dazs attained a real competitive advantage by offering one of the best premium ice creams in the market and through out the years the kept the same business model. Seven years later The Pillsbury Company bought Haagen-Dazs but they remained committed to the tradition of superior quality and innovation on which this ice cream was created. Through out the different merges and acquisitions Haagen Dazs has maintain its competitive advantage and this is why it over 80 years after its creation thisand is recognize as a premium ice cream with top quality ingredients and wide range of innovative flavors.

Ben and Jerrys

If Uniliver wants to remain a key player in the premium ice cream industry with the Ben and Jerrysand, they have to carefully analyze the mistakes made by Ben & Jerrys over the last five years.

ɨ At one stage, Ben & Jerrys pricing strategy worked really well but the demand over recent years shifted towards lower priced products, leaving pricing strategies being a big issue for the company. All of Ben & Jerrys promotions were gained through the companys socially conscious practices but price wars with main competitors left the company having to pull funds off advertising campaigns to fund price discounts.

ɨ Due to the fact that imitations for the product were being developed more rapidly, Ben & Jerry changed their primary marketing goal to establish products that cannot be imitated, but the technological developments of the company did not allowed them to launch the products within a decent time limit. It will be for Unilever key to introduce new flavors quickly. Research will be key in identifying the market in any region or country B&J wishes to operate, especially into consumers needs and wants.

ɨ Ben & Jerry was proud of the success rate of their relaxed, casual culture and having employees involved in the decision making. However this policy needs to be reviewed as decisions are taking too long to be made due to large staffing numbers.

ɨ Ben and Jerrys also faced some economic and social factors that affected them. In 14, sales were flat, profits were down. The coming of the baby boom in the 10s meant a middle class society that was more health conscious. Ben & Jerrys realizing its fall in sales, quickly responded to the changes in consumer demands and introduced Ben & Jerry Lite. This line failed because they didnt forecast and acknowledge the changes in consumer tastes, and was faced with increasing competition with Haagen-Dazs.

ɨ Their social commitments to their customers community and suppliers have contributed to a successful and unique image. Ben & Jerry donated a portion of their sales from their "Rainforest Ice Cream" back into environmental preservation causes in South America. Such efforts had contributed to winning over certain consumers, however we dont know to what extent this will have on winning the hearts of international consumers.

There are a few things that Ben and Jerrys could possibly do to improve their success in the near future. In todays environment, change, rather than stability, is necessary. One of the reasons why B&J lost market share is because they failed to change themselves and adapt to a new competitive environment. To overcome this, Ben & Jerry need to identify the main barrier to change such as consumer tastes. This can be overcome through the development of a marketing plan, as there seems to be no real evidence that Ben & Jerry have done this.

Employee productivity is one of the key components of a companys efficiency and cost structure, so this needs to be improved upon in order to make the company more competitive, although I suspect since Uniliver bought them this not as big of an issue any more.

In conclusion, I think that Ben & Jerry has the potential to prosper as long as they are prepared for upcoming changes in consumer needs and wants, compromise between maintaining their company image and satisfying their investors needs, and try to reduce their costs by considering all of their other options.

regret. The man in this story seems to have made many mistakes in his life. As he tells us

right from the beginning, his first mistake is marrying his wife, Marge, and his second

mistake was getting her pregnant. Marge seemed to want to have control over their lives,

Essay service for your "my side of the matter" paper because she moves them to her Aunts house where her husband is not welcome. There,

being as submissive as ever, doesnt argue with her aunts when told her husband cant

sleep with her. To me, her aunts are a little naive to think that this married couple should

not sleep in the same bed. But on top of that, the aunts treat this man with no respect,

insulting his manhood and being outright disrespectful towards him.

I also think this man needs to communicate more with his wife. They seem to be

on a strange level, one that is not very loving or sensitive. Marge hardly ever sticks up for

her husband while her aunts bash his confidence, making fun of him for just cashiering at a

store. Personally, comparing this story to "The Somebody" I think they should be grateful

this man even has a job. There is nothing they can do about their niece being pregnant, and

its not like she isnt married. Marge needs to move on and connect with her husband, I

think they could work out most of their problems if they just talked with each other.

The main tone is this story would probably be described as annoyed. Everyone

seems annoyed at each other. In the beginning the man is annoyed with his life and his

choices. The married couple are annoyed with each other and finally, the aunts are

annoyed with the nephew-in-law and each other. No one in this story seems to be happy

about anything, they all fight, they are all angry, and they cant really agree on anything,

leaving them with the extreme measures the aunts took. Whether the husband is telling the

truth or not, I do not know. But by the looks of that family, it wouldnt surprise me if itwas.

One part of this story that is a strong image and opened a doorway for discussion

happened many times. Each thing the husband said something about the aunts, I get the

feeling he is only doing it because deep down he probably likes them. He talks about them

numerous times, and to me, if he didnt like them so much, he would never talk about

them as much as he does. Instead, to some extent, I think he likes the way they are strict.

In the beginning, he said himself that he regretted marrying his wife. So when the aunts

told them they couldnt sleep together, I think the husband was happy about it, although

he didnt want to show it.

It seems like there is something missing in this story. I dont find it really is making

a very good point. I am confused as to why the man felt he had made so many mistakes.

Why doesnt he get out of it if he is so unhappy? I think there is a deeper meaning than

what I am getting from it. "My side of the matter"

Order your Smoking paper at affordable prices! The City of Winnipeg Smoking By-Law The by-law that was passed by city council in July is subject to a number of interpretations and is also subject to a variety of enforcement standards. This is a totally unfair bylaw which makes one set of rules for bars and another for restaurants with liquor licenses and yet another for unlicensed restaurants. Lets look at a number of scenarios to try to clear the muddy waters. I have an unlicensed restaurant… what can I do? OPTION 1 You can go 100 % non smoking, which is the intent of the bylaw or OPTION You can ban anyone under the age of 18 from coming in and have 100% smok- ing or you can declare any other ratio that you decide. Ie. 50 50 Problem Legal opinion says that this may be challengeable under Human Rights, but we are banning under 18 from lounges and casinos already. It is not legal to buy ciga rettes, drink or gamble under 18 and the city is saying that they shouldnt be in any area that has smoke. OPTION You can apply for a dining room and cocktail lounge license. You would make applica- tion to the Manitoba Liquor Commission to get a license for your premises. The desig- nated cocktail lounge would ban under 18 and would have smoking allowed. You would have the option of selling liquor or not. If you take this route and want to serve custom ers before 00 A.M., which is the earliest that lounges are able to open, you would need to apply for written permission from the MLCC. I am told that it should not be a problem to get this permission. Problem It is costly and time consuming to get a license and part of your establishment might have to be reconfigured to identify the cocktail lounge area. OPTION 4 Some establishments that have two clearly separated areas are going to have one area as a restricted area and have smoking in that section. Whether this is legal or not is a gray area, but when you consider the level playing field scenario you would think that it shouldnt be necessary to get a liquor license to compete on a level playing field with licensed restaurants. OPTION 5 Another "gray area" option is timed restrictions. Example You have non smoking be- tween the hours of 500 P.M. and 00 P.M. and after 00 P.M. no one under 18 is allowed to come in and smoking is allowed. I have a licensed restaurant…..what can I do? You are allowed to have smoking in your lounge as long as you do not allow anyone under 18 in that area. Some other possible problems may arise if people have to go through your smoking area to get to your washrooms or to the non smoking area. Lounges do not have to be walled off, but an effort should be made to minimize drifting of smoke. Within this area you can designate it as 100% smoking or any other ratio that you decide. If you have a lounge that borders closely on a dining room you might take reasonable steps to control drifting of smoke by declaring the area in the lounge which borders on the dining room as a non smoking area. What are the restaurants obligations under this bylaw? Your only obligations under this bylaw are to designate the areas as you are defining them and to post non smoking signs in the applicable areas. A customer smoking in a non smoking area is subject to a fine not the restaurant. The problem with this scenario is that if you do nothing about the smoker you will anger the non smoking customers around them. Your role is not one of an enforcer under the bylaw, but you are forced into this role by good business rules. Other info These rules apply only to the public areas of the restaurant. You can still have a smoking staff room. Banquet rooms….If you have a party booking a private room for a banquet which is a social event that room can have smoking and children present, but if it is for business purposes (which ironically would have adults only % of the time) must be smoke free. Hint You might consider booking business meetings followed by social events separately if the customer wants a smoking event. Enforcement This by-law comes into effect January 1, 00 and enforcement of this bylaw is being headed up byian Rivet (86-67) of the City of Winnipeg Environmental Health Department. This bylaw applies to all of the city, but the enforcement will be concentrated in the Greater Winnipeg area looked after by the city health department. The province has stated that it will not be adding any staff to enforce the bylaw in the other areas. Enforcement in these areas will probably be only by customer complaint. Challenging the by-law There is a possible challenge to this by-law based on the fact that the City may not have the power to pass a bylaw which has exclusions. This means that any bylaw passed would have to cover all public places, which would create a far more level playing field. This would require a court challenge which would be costly and we would have to call on our members for support in this matter. Please keep in touch with me on this issue and how it is affecting you. If you have any concerns regarding the enforcement please call. Have a great Christmas and Happy New Year. • Cold temp. causes increased heat production. Thus body temperature is elevated.

• Dehydration causes increased thirst. Decreased urine volume. This causes the body to accumulate fluid. • Hypocalcemia causes Ca++ mobilization from bones. The increased plasma calcium corrects the hypocalcemia.

• Fall in blood pressure causes increased heart rate, force, increased blood volume. These all elevate blood pressure.

Positive Feedback (amplification) mechanisms.

o Blood clotting. Platelets release chemicals which attract more platelets and trigger them to release their chemicals.

o Birth process As infant moves along the birth canal, stretching tissues and stimulating stretch receptors, this causes release of oxytocin, which cause muscular contractions and moves the infant along birth canal, stimulating more receptors.

When I first started reading this novel, I thought it was kind of dull and boring. Now that the story has really started to develop, I am starting to really like it. Grant seems to have too much pressure on him. He has to please his aunt, Jeffersons aunt, and the people of the white community. He has to please his aunt because she wants him to be the best that he possibly can be.

I dont think this story is about Jefferson turning into a man, I think its about Grant becoming a man. This story has been very interesting so far. It deals with racism and the saying, "innocent until proven guilty." When I first started reading this novel, I thought it was kind of dull and boring. Order your The bylaw of smoking paper at affordable prices! Do-gooders at City Hall have launched an ad campaign to boost a new anti-smoking bylaw.

Come the New Year, smokers will be banned from privately owned joints where children are present, such as restaurants and hotels.

A new billboard spotted on the south side of the Disraeli Freeway over-dramatizes the anti-tobacco crackdown with the face of a hapless kid engulfed by a waft of smoke that could easily be mistaken for the pits of hell.

The billboard issues this warning Where minors are permitted inside, you smoke outside. Professional writers help on The bylaw of smoking essays You dont have to convince me that cigarette smoking is bad news. But even more disturbing is the creeping infringement on individual rights and private property that has been ushered into law by the anti-smoking zealots.

The whole lot of them are a tiresome group of neo-puritans professing to know whats best for us. For whatever reason, they single out smoking as enemy No. 1 even though deadly heart disease and cancer can be attributed to other poor lifestyle choices.

So, once smoking is banned, whats next -- Whoppers with cheese?

After a while, their chiding all sounds the same. Thou shalt not smoke, drink, own a rifle, advertise ideas during elections, fortify your home, rear your children as you see fit or in any way care or think for yourself.

Now the butt outigade is getting in a few extra licks by extending the smoking ban to the citys 71 community centres.

The new law could have a crippling effect on programs and basic operations that depend heavily on cash raised from bingo nights and socials, say some community club reps.

Strip away the million bucks in private fundraising and the city will have to beef up operating grants over and above the existing $4-million mark.

And thats bad news for over-taxed Winnipeggers but not for everyone.

The displaced bingo nights and socials could be a boon to private halls and hotels recently straightjacketed by the new smoking ban. If its not new business, it at least levels out the playing field.

But level playing fields that cut across public and private lines should make Winnipeggers feel uneasy.

The anti-smoking bylaw is just the thin edge of the wedge. Next on the hit list is the convention centre. After that, it wont be long before our modern day prohibitionists try to outlaw smoking in the privacy of your own homes, with or without minors. I kid you not.

A county in Maryland, U.S.A., did just that. They recently passed a bill that penalized residents with a $750 fine for smoking at home if tobacco fumes lingered into a neighbours property.

Whats next on the thought-control agenda, curfews for adults and compulsory exercise classes? Locals protested against the Orwellian law, and the bill was eventually scrapped.

And thats the trouble with Winnipegs reckless anti-smoking law. It blurs the distinction between public and private property and paves the way for lawmakers to legislate against and emasculate individual authority over your own household.

Respect for private property and individual rights are non-negotiable and if measured in terms of importance, expose the tobacco ban for the petty nuisance that it is.

When we agreed to write this column on anti-smoking bylaws, I worried it would be hard to find a new way to talk about how unhealthy second-hand smoke is.

I mean, we all know it, dont we?

Boring.

But when I dug out the statistics ... wow. Theyre the kind of thing that can leave you moreeathless than a two-pack-a-day smoker whos just climbed four flights of stairs.

For example On average, a person working in a bar smokes about eight cigarettes a night. Or, I should say, they inhale the equivalent via second-hand smoke.

Researchers in Ontario recently found that second-hand smoke triples the risk for cancer-related illnesses. And heres another statistic for you Doctors estimate that up to 00 people die each year from second-hand smoke in Manitoba.

Imagine anything else so poisonous it kills 00 people a year in this province floating around workplaces. The health and safety department would swoop in and close the place down in less time that it takes the Marlboro Man to cough up a mouthful of phlegm.

No one should have to work with asbestos or PCBs and no one should have to work in an environment filled with second-hand smoke. Thats kind of like lighting a full garbage can on fire, leaning over it andeathing deeply to enjoy a delicious lung-full of the smoke.

The one difference being that cigarettes contain up to 50 chemicals you would never find in a garbage can -- because theyre so deadly theyre banned when sold on their own.

When bar and restaurant owners complain about anti-smoking bylaws hurting business, you have to wonder. What if bar owners said that they wanted to be able to pipe noxious fumes into their establishments because this made people thirstier?

Would we just say, Oh, well, if it hurts business, dont let us stop you! Go ahead and do whatever you want!

And another thing. When they say that eliminating smoking from bars, restaurants and other public venues will kill those businesses, theyre wrong.

A recent poll by the Manitoba Medical Association found that, of those surveyed, the number who say they would go more often is greater than those saying they would go less often. Food courts, where non-smokers would no longer find it necessary to try to eat through a gas mask, could expect a 16% increase in business.

There was a bit of aouhaha recently when community centres complained that anti-smoking bylaws would hurt their chances at financial survival. I agree that this is a serious concern -- not the non-smoking bit, the fact that community centres DONT HAVE ENOUGH MONEY!

Can you believe this? Community centres are being forced to choose between a toxic environment and no environment at all. What kind of world is this?

City council should pass the anti-smoking bylaws, increase funding to community centres and then take the rest of the day off. Theyd deserve it.

Recent moves by city hall mean that fewer kids will be exposed to second-hand smoke in public places. It sounds perfectly reasonable to me to try to eliminate young peoples exposure to second-hand smoke. Or is poisoning kids just the cost of doing business?

The presence of about 5,000 U.S. troops in Saudi Arabia, home to Islams two holiest sites, is one of Osama bin Ladens bitterest grievances against Americaboth because he is offended by having infidel troops stand guard over Islams holiest sites and because the U.S. presence makes it harder for him to topple the Saudi monarchy.

Why are U.S. forces in Saudi Arabia?

Their purpose is to deter Iraq from attacking Saudi Arabia and monitor the no-fly zones (which are off-limits to Iraqi planes), U.S. officials say.

Has bin Laden called for a U.S. withdrawal from Saudi Arabia?

Yes, repeatedly. In his writings and speeches, bin Laden has hotly argued that since at least 11the year of the Persian Gulf War, which was waged by a U.S.-led coalition with bases in Saudi Arabiathe United States has been occupying the lands of Islam in the holiest of its territories, Arabia, plundering its riches, overwhelming its rulers, humiliating its people, threatening its neighbors, and using its bases in the [Arabian] peninsula as a spearhead to fight against the neighboring Islamic peoples.

When did significant numbers of U.S. troops arrive in Saudi Arabia?

The Saudis invited in the U.S. military shortly after Saddam Hussein invaded Iraqs oil-rich neighbor Kuwait, on August , 10. To help protect the kingdom and prepare to expel Iraq from Kuwait, the United States sent about 500,000 troops to Saudi Arabia; the U.S. secretary of defense at the time, Richard Cheney (now vice president), promised Saudi King Fahd that the troops would be removed after the war.

When did bin Laden turn against the Saudi royal family?

Bin Laden, a Saudi himself, oke with the Saudi monarchy over the Gulf War and now avidly seeks its overthrow. In 10, bin Laden approached the Saudi defense minister and volunteered to mobilize veterans of the 17-8 Afghan jihad against Soviet occupation to defend Saudi Arabia against Iraq. The Saudi government declined his offer, preferring to rely instead on the U.S.-led coalition assembled by President George H. W. Bush. Ever since, bin Laden has resented the presence of infidel troops on the holy land where the Prophet Muhammad founded Islam in the seventh century.

What sort of U.S. military personnel serve in Saudi Arabia?

About 80 percent of U.S. forces in the kingdom are Air Force personnel.

Order your Capital Punishment paper at affordable prices! Murder is the unlawful killing of another human being with an intentional or criminal intent. In today's world, terrible crimes are being committed daily. Many believe that these criminals deserve one fate: death. Capital punishment, the death penalty, is the maximum sentence used in punishing people who kill another human being - and is a very controversial method of punishment.

In most states, a person convicted of first degree murder has the potential to be given the death penalty. Capital punishment is a subject that can be counted upon to stir emotion and controversy into any conversation or argument. The very concept provokes a profusion of valid questions and opinions. Today's daily world of crime and violence calls for punishment of a severe nature, and many citizens argue that the punishment necessary is the death penalty. These people quote passages such as the "an eye for an eye, tooth for a tooth" concept from the Old Testament of the Judeo-Christian bible. Some people take the neutral position that there is no right or wrong answer, that each opinion on capital punishment is valid in its own way. Opponents of the death penalty claim that sentencing a person to death does not change the reality of the situation; the harm already done simply cannot be fixed from a vengeance standpoint. You cannoting the murdered person back by taking the prisoner's life. Proponents of capital punishment tend to defend their opinion mainly on two grounds: death is a fitting punishment for murder, and executions maximize public safety through incapacitation and deterrence.

The view of proponents of the death penalty in reference to the "let the punishment fit the crime" ideal is that, in the eyes of many law officials and citizens of the United States, if a crime is so serious that it causes irreversible damage or the loss of human life, then the only penalty for such crimes would be death for the individual that committed this act. Many also feel that if an individual can possess the strength and will to take the life of another human being in a planned manner, then they must also in turn be able to face their punishment which could only be a punishment of the same magnitude as the crime they have committed; that being for their life to be ended for the common good. These people feel that, while it is the cruelest punishment, it is the best way to penalize heartless, cold-blooded killers.

The ideal of executions maximizing public safety through incapacitation and deterrence explains that such a punishment as the death penalty would keep callous and dangerous murderers from roaming the streets of our children and innocents. It would serve to "scare" criminals into not commiting their crime for fear of the ultimate punishment. It seems rational to think that if potential killers are aware that if they commit serious crimes they could be put to death for it, they are less likely to commit these crimes. Another strong point of this concept is the retribution and justice bestowed to society. The community demands a sense of closure, that justice be served. This is imperative for peace to be maintained. If criminals were allowed to get away with such a serious crime as the taking of human life, fear and chaos would rule. A sentence of life in prison is not substantial enough. The government must be trusted to permanently protect its innocent citizens from further crime.

College Essays on Capital Punishment ***

The following is a description of a common execution:

"At 8:30 p.m. the first jolt of 1900 volts of electricity passed through Mr. Evans' body. It lasted thirty seconds. Sparks and flames erupted from the electrode tied to Mr. Evans' left leg. His body slammed against the straps holding him in the electric chair and his fist clenched permanently. The electrode burst from the strap holding it in place. A large puff of grayish smoke and sparks poured out from under the hood that covered Mr. Evans' face. An overpowering stench of burnt flesh and clothing began pervading the witness room. Two doctors examined Mr. Evans and declared that he was not dead."

The death penalty in the United States should be abolished without exception. The problems associated with this controversial form of punishment are uncountable -- morality, innocence, money, unjustified retribution, racism -- and cannot be resolved without the abolition of such punishment.

In response to the "eye for an eye" concept, opponents of capital punishment inevitably take the standpoint that killing one another is wrong in every manner regardless whether it is just or not. A society that respects human life does not deliberately kill human beings. An execution is a violent public spectacle of official homicide and one that endorses killings to solve social problems. It is unjustified retribution Capital punishment is cruel and unusual punishment , being a relic of when slavery, anding, and other such corporal punishments were common.

The main argument used by death penalty supporters is that capital punishment deters murders. They argue that it is the duty of the government to protect it's citizens by permanently incapacitating criminals. This would be a perfectly cogent standpoint, if it were actually accomplished by the death penalty. However, the death penalty fails to deter further murders for a few underestimated reasons. Instead, as it is shown in a number of recent surveys, it actually seems to produce an increase in criminal homicide. This form of punishment fails as a deterrent for several reasons. The following facts illustrate this point:

1. Death penalty states average an annual rate of 7.9 homicides per one hundred thousand people while abolitionist states average 5.1 murders for the same amount of people.

2. The death penalty was reintroduced in Oklahoma in 1990, only to cause the addition of one stranger-murder per month in the state.

3. A survey of criminologists from the American Society of Criminology, The Academy of Criminal Justice Sciences, and also The Law and Society Association proved that an overwhelming majority of experts did not believe that the death penalty is a deterrent to murders. Over 80% believe that the existing research does not support a deterrence justification for the death penalty.

When a crime is planned, the criminal concentrates on escaping, arrest, and then the possibility of conviction. The threat of even the most intimidating punishment will not stop a murderer if he or she expects not to get caught. However, you will find that the majority of murders are commited in the heat of the moment, or when the murderer is under great emotional stress, or under the influence of alcohol or drugs, which, of course, dismisses rational judgment.

United States Attorney General Janet Reno says that she has yet to find any evidence that the death penalty deters crime. She quotes, "I have inquired for most of my adult life about studies that might show that the death penalty is a deterrent. And I have not seen any research that would substantiate that point."

It is clear that a lack of ignorance establishes beyond a reasonable doubt that capital punishment fails as a deterrence to murder. No comparable body of evidence exists that contradicts this conclusion.

It is sometimes argued that abolishing capital punishment is unfair to the taxpayers. This is assuming that life imprisonment costs are more than those of when the death penalty is an issue. However, if you were to add up the costs of litigation -- the time of judges, prosecutors, public defenders, court reporters, and the high cost ofiefs -- you would find that the contrary is true. In the court of law, time is money, and a capital punishment is inevitably going to be much longer, not to mention the chance of an appeal will go much higher.

A good example would be Florida, a state with one of the nation's most populous death rows. The state has estimated that the actual cost of each execution is approximately $3.2 million, or six times the cost of a life imprisonment case. A 1993 study of the costs of a state's capital punishment system revealed that litigating a murder case from beginning to end is $163,000 more than what it would take to keep the offender in federal prison for twenty years.

It is commonly reported by the media that public opinion is in favor of capital punishment. However, a more careful analysis reveals that most Americans prefer an alternative; they would oppose the death penalty if more criminals were convicted to a life sentence without parole.

It is reported that if the alternative were life imprisonment without possiblity of parole, plus financial restitution to society, only a minority of the American public would support the death penalty.

Capital punishment is forbidden by law and widely abandoned in practice worldwide, in almost every country outside the U.S.. There are 50 national organizations that are involved in the National Coalition to Abolish the Death Penalty in American alone.

Both the issues of innocence and racism are prevalent when the death penalty is at hand. In 1980, in the state of Texas, a black high school janitor, Clarenceadley, and his white co-worker found the body of a missing 16-yr old white schoolgirl. Interrogated by the police, they were told, "One of you is going to hang for this." Looking atadley, the officer said, "and since you're the black one, you're elected." In a classic case of rush to judgment, adley was tried, convicted, and sentenced to death. The circumstantial evidence against him was thin and the racism was heavy. In 1986 Centurion Ministries, a volunteer group devoted to freeing wrongly-acused prisoners, came toadley's aid. Evidence had meanwhile emerged that another man had commited the murder for whichadley was awaiting execution.adley was not released until 1990, a full year later.

Right now, over 3,500 inmates sit in wait on Death Row nationwide. The overwhelming majority are poor, and a disproportionate number are African American or of some other ethnic minority. In addition, most had legal representation that ranged from inadequate to grossly incompetent. However, what may be the most disturbing of all is that a significant number of them may be quite innocent. It is proven fact that, since the Supreme Court reinstated capital punishment in 1976, at least one of every eight people sentenced to die by the death penalty in America is later proven innocent.

Morality itself should be virtue enough to at least call for the moratorium of the death penalty in the United States, the land of freedom and justice. Capital punishment blatantly violates the very concept of justice and is unacceptable as a form of punishment. The Marquis de Lafayette, a good friend of the United States during the Revolutionary War, once said, "I shall ask for the abolition of the punishment of death until I have the infallibility of human judgment demonstrated to me."

Some radical death penalty opposers even go so far as to claim that those who support such punishment with the excuse of "an eye for an eye, a tooth for a tooth" are like immature children who continue to insist on the principle of childish payback and petty revenge. They s

y that these people did not listen to their mothers when they were told "two wrongs do not make a right." They say these men and women have not grown out of a tendency toward violence and a shunning of the virtues of mercy and forgiveness, in addition to morality.

Opposing the death penalty does not mean sympathy with convicted murderers. On the contrary, murder and manslaughter both demonstrate a lack of respect for life. For this very reason, a policy of state-authorized killings is immoral. Criminals no doubt need to be punished, but severity of punishment should have its limits, beginning with the use of human dignity. Governments that respect these limits do not use premeditated and violent
